The Unprotecting: A Public Lands Tracker
EOs and legal opinions, the industries moving in, who benefits, who resists — the nationwide attack on public lands, tracked the way we track the wall
First issue of a new tracker, built on the pattern of the Border Construction Dossier: instruments, sites, beneficiaries, opposition, watchlist. Thesis of the file: the border wall was the pilot program — suspend the law by executive instrument, transfer or unprotect the land, extract, and litigate later. The monuments are the rollout. Text captures for starred sources are in the project folder. Status tags: DONE executed · ACTIVE in motion · THREATENED signaled · BEATEN stopped by opposition.

Reading the board
Put the two trackers side by side and the machinery is identical. An executive-branch legal instrument switches off a statutory protection (§102 waiver / OLC revocation opinion). The land changes status faster than any court can respond (bulldozers in Big Bend three days before groundbreaking was announced; mining claims staked within days of July 13). A small set of connected private actors captures the value (Fisher and Barnard; Energy Fuels and the lease-sale winners). The disciplined opposition wins only where an old, unglamorous legal hook survives — water law, irrigation districts, state land offices, and now, potentially, securities law. The Energy Fuels probe matters for exactly that reason: insider-trading law is the public-lands version of the irrigation district — a rule the emergency framing forgot to waive.
